of Trade Definitions1.
"The Company" means Computer World. "The Buyer" means the
person, firm or company ordering or buying the goods from the company. "The
End User" means the buyer or any user of the company's products. RTB means
to return to base refering to The Company premises. General 2.
The Company reserves the right to reject any order received for goods. Any order
received that amends these terms is subject to written acceptance by The Company.
Payment and Title 3.
The goods remain the property of The Company until all due funds relating to the
goods have cleared. Payment may be made by the following cash, personal cheque,
company cheque (by prior arrangement), banker's draft, cashiers cheque or electronic
transfers of funds into an account nominated by The Company. The Company may recover
payment by way of customer not present transaction for any outstanding payment
or debt, this may be taken from by a previously used debit or credit card. 4.
The buyer agrees that the company, or its representatives may enter the buyers
premises at any reasonable time in order to recover goods originally supplied
by the company for which payment is outstanding beyond any previously written
agreed credit term. 5.
Any items accepted by The Company either for repair, returns or estimate will
be disposed of in the appropriate manner after a period of 30 days unless otherwise
arranged in writing with a representative of the Company. Defective
products 6. All new products supplied by the company are supplied with a one-year
RTB warranty. Defective goods may be returned to The Company at the buyer's expense.
The Company may, after verifying the defect, replace, issue a credit note or repair
the goods at the Company's discretion within a specified period. The Company is
not responsible for goods returned to us that are lost or further damaged in transit. 7.
All second user products supplied by the company are supplied with a 7 day RTB
warranty. Defective goods may be returned to The Company at the buyer's expense.
The Company may, after verifying the defect, replace, issue a credit note or repair
the goods at the Company's discretion within a specified period. The Company is
not responsible for goods returned to us that are lost or further damaged in transit. 8.
Defective good returned under clauses 6 and 7 if found not to be faulty may be
subject to test fee at The Company's discretion. Delivery 9.
Unless otherwise agreed between the Company and the buyer, all goods are to be
collected from the company's premises. 10.
Delivery charges are charged at Parcel Force rates. Expedited deliveries may incur
additional charges which will be agreed in advance between the company and the
buyer. The company will make its best endeavours to deliver all goods as instructed
by the buyer. The company will not be responsible for late deliveries outside
of its control, however caused. 11.
The buyer shall inspect all goods immediately they are delivered to him. The company
reserves the right to reject claims for incorrect delivery 24 hours after date
of delivery. Force
Majeure 12. The Company reserves the right to cancel, suspend or vary the operation
of contract of sale if events occur which are in the nature of force majeure including
but not limited to fire, flood, storms, plant breakdown, strikes, lockouts, riot,
hostilities, non-availability of material of suppliers. The company shall not
be held liable for any breach of contract result from such events. The comapny
reserves the right to alter terms of trade.
Hardware/Software
installation responsibility 13. Before equipment is accepted in by the company,
we would ask that to minimise the risks involved in adding hardware or software
to an existing system, you check the following. " That all the data held
on your system is secured by means of backup. The Company is not liable in any
way for any loss of data. " That by our technicians installing any hardware
or software, it does not invalidate any other warranty or service contract you
have on the equipment. The company will not be responsible for loss of any warranties
or service contracts. " Whilst every endeavour will be made to prevent
possible resultant damage to your equipment or data, Computer World is not held
responsible or liable for any loss of data in any form or equipment failure/fault/damage. Warranty
Repair 14. All equipment covered by the company warranty, within the limits
of its warranty period, will be replaced or repaired, providing clauses covered
under the heading Defective Products are agreed. Some items such as Monitors,
Laptops may be covered under manufatures warranty (see doccumentation inside packaging)
in these cases warranty clams and cases rest with manufaturer for repair or replacement. 15.
If a fault is found to be caused by the end user or components other than the
Company's, our normal repair charges will apply. 16.
Software or software problems/faults is NOT covered by our warranty. 17.
Normal repair charges will apply should the company be required for re-installation
or reconfiguration of equipment or software as a result of accidental damage,
misuse or software fault. 18.
Should the Company find the warranty seals have been removed, broken or in anyway
tampered with, the buyers warranty with the Company will be null and void. Should
the buyer wish to upgrade the equipment in such a way that it would break the
warranty seal, the buyer should contact the Company for assistance (free of charge
at the Company's discretion)
19.
If the parts supplied by the Company are fitted by anyone other than a company
representative, the validity of the warranty will be subject to inspection by
a Company technician. Returns 20.
Items may be returned for refund at our sole discretion. A restocking fee of 20%
of the retail value of the item will be made to cover our costs. 21.
The Company sells the goods to the Buyer on the understanding that the Buyer or
the representative of the buyer has sufficient technical knowledge to correctly
fit and use the goods. Returns that contradict this will be rejected. 22.
Returned goods must be returned as sold with all retail packaging, software, drivers,
leads and without damage. Consumable
Products 23. The Company supplies no warranty or guarantee with consumable
products. These include mice, keyboards, ink, paper, mousemats, CDR, CDRW and
any type of writable media. 24.
It should be noted that most printer suppliers do not recommend the use of ink
refill kits or compatible cartridges. Because of this, the Company will not be
liable for damage resulting from the use of these products. Software
Piracy 25. The Company abides by the strict copyright laws regarding software
ownership and licensing. All instances of software piracy are reported to the
proper authorities. Law 26.
These conditions of sale shall be constructed in accordance with English Law and
do not affect your statutory rights.
